Francesca O’Neill successfully obtains Extended Civil Restraint Order in the High Court following strike out

Francesca O’Neill successfully obtained an Extended Civil Restraint Order against a Mr AKM Soeb in respect of his serial litigation against the Home Office. Mr Soeb has brought three claims against the Secretary of State for the Home Department since 2019, alleging that he had suffered serious loss as a result of breaches of the Human Rights Act, defamation and delay. His most recent claim was pleaded at £20 million.

HHJ Tindal (sitting as a High Court Judge) said, granting the application, “I am conscious that Mr Soeb has rights both under the common law and under Article 6 ECHR. The court should be extremely cautious and careful to make any order as requested. What is proportionate? It seems to me that I have looked carefully whether the risk could be managed either without making such an order or making one for a shorter period. I am satisfied that I have carefully thought about this and only an extended CRO will do and for the full 2 years”

Francesca was instructed by the Government Legal Department and is on the Attorney-General’s Panel of Counsel.
