R (on the application of P) v The S&SE Hampshire Youth Court

[2005] All ER (D) 142, [2005] EWHC 764 (Admin) 2005-06-01

A Judicial Review of a decision by the Defendant Youth Court to adjourn a trial.  This case concerned the evolving duty on the defence to disclose to the prosecution flaws in the prosecution case prior to trial, particularly in the ambit of summary justice.  Simon Murray acted for the claimant, a child of 16.  The Court dismissed the application.  However, Laws LJ on behalf of the Court certified, following Simon's application, two questions as raising two points of law of general public importance, for the purposes of an appeal to the House of Lords.
