Section 329 Criminal Justice Act 2003: permission to bring proceedings.  Proceedings issued without permission were found not to be a nullity.  It was open to the claimant to seek permission after issuing proceedings.  Permission would be granted to the claimant on the facts: the court was entitled to infer that there was evidence of 'grossly disproportionate' force notwithstanding the absence of direct evidence from witnesses as to the use of such force.
